Satisfaction Guarantee and Return Policy

We are pleased to provide you with our guarantee of satisfaction on all products manufactured by Gavel & Gown Software Inc. (“G&G”). If the software is not satisfactory for any reason whatsoever, it may be returned for a full refund within 30 days of shipment, or up until you receive your first license from Gavel & Gown Software, whichever comes first, less shipping and handling charges. This applies to new licenses only. Services fees or upgrade licenses are not refundable.

In providing this guarantee we rely upon the legal profession’s respect for copyrights and intellectual property. We also require your reasons for returning the software. We are committed to providing the highest possible quality products, and if there is anything wrong or anything that could be improved, we need to know about it.

Software will be accepted for return only if:
• it is accompanied by a copy of the original invoice;
• it is accompanied by a signed statement giving the reason for the return and
stating that no copies have been retained; and
• if purchased from a reseller, it is returned to that reseller, or if purchased
directly from G&G, it is accompanied by an email confirming the return from G&G.

Apart from the limited warranty set out in the License Agreement, G&G disclaims all other warranties, express or implied, concerning the software. The software and related material are provided “as is” without warranty or condition of any kind, including but not limited to the implied warranties or conditions of merchantable quality and fitness for a particular purpose. G&G does not warrant that the software
will meet your requirements or that its operation will be error free. In no event shall G&G be liable to you or to any third party for any direct, indirect, special or consequential damages, whether foreseeable or not, even if advised of the possibility thereof. This limitation and exclusion applies irrespective of the cause of action, including but not limited to breach of contract, negligence, strict liability, tort or any other legal theory and shall survive a fundamental breach.

To return software, call the agency from which you acquired it. If the software was acquired directly from G&G, talk to your account executive and ask for an email confirming the return. You are responsible for shipping and delivery costs. Use regular mail only. Any necessary customs declaration should state: “Software manufactured in Canada being returned.” G&G will not deal directly with returns where the software was acquired through a reseller — consult the reseller through whom you acquired the software and follow their return procedures. There is a $25 per copy handling charge for all product returned.
